«Невозвращенец» из числа первых, неожиданно оставивший службу в парижском торгпредстве и ушедший, что называется, по-английски, не прощаясь и никак не объясняя причину своего разрыва с советским режимом, Борис Григорьевич Зуль был известен в среде партийной элиты как старый большевик, участник революционных событий 1917 г. и гражданской войны, выдвинутый еще Ф. Э. Дзержинским, в бытность его наркомом путей сообщения, для работы по морскому транспорту.

Note.—In this case, which does not require more than a note, the suppliants brought proceedings by Petition of Right claiming from the British Government: (i) the return of certain vessels; (ii) a declaration that the vessels belonged to them as
a separate entity and as distinguished from the
Soviet Government; (iii) compensation for their use, Bailhache, J., decreed that the ships of the " Russian Volunteer Fleet " should be returned by the British Government to that body (the Soviet Government making no claim to them). He held that the claim for compensation for the use of them by the British Government in and after March, 1918, could not be entertained by the Court because such a claim was barred by the provisions of the Indemnity Act, 1920. The suppliants might bring that claim before one of the tribunals created by the Indemnity Act, 1920. The status of the " Russian Volunteer Fleet" was examined at length, and the learned judge made a declaration that by reason of its statute of 1912 it was an entity distinct from the Soviet Government down to January, 1918, then ceased to be a separate entity, but became so again in October, 1922, as the result of a new statute. The following passages may be quoted from the judgment (at p. 78):
" When the duly accredited representative of a sovereign " power, recognised as the de facto or the de jure Government " of this particular country, . , . makes a communication " claiming certain property in this country, it is not the " practice of the Courts in this country to inquire whether his " claims are well or ill founded. . . . [The claim] will be " accepted as final and good, but where a sovereign power " disclaims property or makes no claim to it, I apprehend that " the Courts of this country are then entitled to inquire whether " the suppliant who claims is or is not entitled to the property
